State and Local Law Enforcement

State and Local Enforcement of Federal Immigration Laws

Section 287(g) Immigration Enforcement (ICE Fact Sheet, revised September 9, 2005)
This 2-page fact sheet produced by U.S. Immigration and Customs Enforcement (ICE) briefly describes a program under Section 287(g) of the federal Immigration and Nationality Act in which ICE provides state and local law enforcement with training and authorization to identify, process, and detain illegal immigrants. The fact sheet is also available directly from ICE's Public Information Page.

Section 287(g) Is the Right Answer for State and Local Immigration Enforcement
An article by James Jay Carafano, Ph.D., published online March 2, 2006, in which the writer provides some description of §287(g) immigration enforcement programs and provides recommendations for expanding and implementing such programs nationally.

Planning for State Immigration Enforcement Legislation
A 2006 paper by the Immigration Reform Law Institute (IRLI). State and local governments have more extensive authority that is generally recognized to enforce federal immigration law and to enact statutes and ordinances to fight violations of federal immigration law. The IRLI makes recommendations on various legislative measures would create a powerful deterrent in illegal immigration, in such areas as illegal employment, identification security and requirements, clarifying police enforcement authority, verifying eligibility for public benefits, and better controling financial transactions by those in the country illegally.

The Quintessential Force Multiplier: The Inherent Authority of Local Police to Make Immigration Arrests
An extensive legal analysis by Prof. Kris W. Kobach, dated February 22, 2006, as published in the Albany Law Review (made available by the Immigration Reform Law Institute). This paper looks at the inherent legal authority under statutes and court decisions upon which state and local police may assist with federal immigration law enforcement, and explains that such authority has not been preempted by Congress, as some have claimed. State and Local enforcement can act as a 'force multiplier' that greatly enhances federal enforcement efforts.
